An "O&E" is the result of a
simple title search of the record from the last arms-length deed
to a current date.
Essentially, it’s a snapshot of the title. It reveals the
apparent record title holder (as indicated by that deed) and any
encumbrances noted in that deed, or any subsequently recorded
deed. It’s a limited title search purporting to show the status
of title based on a limited time search. This document is not a
title insurance policy and carries no guarantees of ownership.
It is a report of what appears of public record (if it is
properly indexed) during a limited time period. This is a good
report for limited purposes but should never be used for a
purchaser to determine ownership. The certificate makes no
representation as to the legal sufficiency of title, or of any
instrument reported therein. The certificate form has been filed
with, and approved by the Florida Department of Insurance in
accordance with Section 627.7843, Florida Statutes. Copies of
the vesting deed and any mortgages, liens or judgments are
provided.
